Our Warranty
LIMITED LIFETIME WARRANTY ON RESIDENTIAL APPLICATIONS. Dakota Kitchen & Bath Inc., warrants to the original homeowner purchaser for as long as they own their home that the "Residential Warranted Products" (as defined below) will be free from defects in material and workmanship under normal home use and service at the original site of installation. This Limited Lifetime Warranty is only applicable to cabinets and cabinetry products and components that are (i) manufactured by Dakota Kitchen & Bath, Inc.; (ii) purchased through a factory authorized Dakota Kitchen & Bath, Inc. dealer; (iii) properly installed; and (iv) used in residential applications within the United States ("Residential Warranted Products'7). This Limited Lifetime Warranty is not transferable. This Limited Lifetime Warranty does not apply to cabinets or cabinetry products and components not manufactured by Dakota Kitchen and Bath, Inc. even if said cabinets or cabinetry products or components are integrated into or used in conjunction with Residential Warranted Products.
In the event that a defect of material or workmanship may exist, Dakota Kitchen & Bath Inc., at its sole discretion and following thorough reviews and inspections of the Residential Warranted Product, will either repair or replace the defective Residential Warranted Product. The remedy available under this Limited Lifetime Warranty is strictly limited to the repair or replacement of the Residential Warranted Product only, and shall not extend to any incidental or consequential damages of any kind or nature. Dakota Kitchen and Bath, Inc. does not and will not warranty any labor and/or other costs associated with the removal and/or reinstallation of any Residential Warranted Products deemed defective, including materials and related cabinetry components.
FIVE YEAR LIMITED WARRANTY ON COMMERCIAL APPLICATIONS. The Limited Lifetime Warranty set forth above does not apply to cabinets or cabinetry products and components that are installed into a commercial application. Dakota Kitchen & Bath Inc., warrants to the original commercial purchaser for a period of five years that the "Commercial Warranted Products" (as defined below) will be free from defects in material and workmanship under normal use and service at the original site of installation. This Five Year Limited Warranty is only applicable to cabinets and cabinetry products and components that are (i) manufactured by Dakota Kitchen and Bath, Inc.; (ii) purchased through a factory authorized Dakota Kitchen and Bath, Inc. dealer; (iii) properly installed; and (iv) used in commercial applications within the United States ("Commercial Warranted Products"). This Five Year Limited Warranty is not transferrable. This Five Year Limited Warranty does not apply to cabinets or cabinetry products and components not manufactured by Dakota Kitchen and Bath, Inc. even if said cabinets or cabinetry products or components are integrated into or used in conjunction with Commercial Warranted Products.

Dakota Kitchen and Bath, Inc. does not and will not warranty any labor and/or other costs associated with the removal and/or reinstallation of any Commercial Warranted Products deemed defective, including materials and related cabinetry
components.
ADDITIONAL LIMITATIONS. No warranty is provided and neither the Lifetime Limited Warranty nor the Five Year Limited Warranty apply to (i) mechanical or electrical items, such as wood hood ventilator power units, hinges and drawer glides; (ii) cabinets that are ordered and manufactured unfinished: (iii) wood edging used on countertop applications; (iv) wood tops with a sink or water source installed in the surface; (v) routed finger pull areas; (vi) cracks in the wood caused by excessive heat or humidity; (vii) finish failure resulting from contact with smoke, grease or any improper cleaning chemicals; (viii) damage caused by others or beyond the control of Dakota Kitchen & Bath Inc., including but not limited to damage caused by misuse, abuse, accident, neglect, alteration, mishandling, improper installation, improper storage, failure to provide reasonable and necessary maintenance, or by flood, fire, earthquake, tornado, or other acts of nature; (ix) products installed in vacation homes which do not maintain year-round environmental controls, or to products installed in areas with exposure to extreme humidity or extreme temperature fluctuations; or (x) the mellowing and aging of wood products, variation in the wood grain or color, fading, or visible cracking around joint areas, particularly finish cracks related to solid color finishes.
With respect to the repair or replacement of a Residential Warranted Product or Commercial Warranted Product ("Warranted Products"), Dakota Kitchen & Bath Inc., reserves the right to alter design, specifications, and materials without obligation to make similar changes to products previously manufactured. The repair or replacement of Warranted Products is contingent upon the current product offerings and construction within the Dakota Kitchen & Bath Inc. product line at the time of the warranty claim. If a warranty claim is filed after a Warranted Product is changed or discontinued, Dakota Kitchen & Bath Inc., reserves the right to honor the warranty by either replacing the affected Warranted Product with a new component of the same style, or replacing the Warranted Product and any other components in the application to achieve a uniform appearance with a similar and comparable product style.
If Warranted Products are replaced, Dakota Kitchen & Bath Inc. cannot guarantee that the finish of these replacements will exactly match the finish and appearance of the original Warranted Products. This is due to the inherent natural variations in woods and changes that occur during the natural aging process of any wood.
The Limited Lifetime Warranty on Residential Warranted Products and the Five Year Limited Warranty on Commercial Warranted Products are the sole and exclusive warranties of Dakota Kitchen & Bath Inc. Dakota Kitchen & Bath, Inc. disclaims all other warranties, either express or implied, including implied warranties of merchantability or fitness for a particular purpose, other than those warranties implied by and incapable of exclusion, restriction, or modification under applicable law. The length, beneficiary, terms and conditions of any implied warranty that cannot be disclaimed is limited to the length, beneficiary, terms and conditions of the Limited Lifetime Warranty or the Five Year Limited Warranty, as the case may be. We do not authorize any other person or company to assume on our behalf, any other liability in connection with the Limited Lifetime Warranty or the Five Year Limited Warranty. The Limited Lifetime Warranty and the Five Year Limited Warranty give you specific legal rights and you may have other rights, which vary from state to state or province to province.
The Limited Lifetime Warranty and the Five Year Limited Warranty apply to orders shipped on or after August 1, 2007. To file a warranty claim request, please contact the authorized Dakota Kitchen & Bath Inc. dealer where the product was purchased. For assistance contacting said dealer, you may contact Dakota Kitchen & Bath, Inc. at 1-800-953-9727. A dated sales receipt as proof of purchase is required to obtain benefits from the Limited Lifetime Warranty or the Five Year Limited Warranty. The authorized Dealer will obtain the necessary information to complete a warranty request and forward the request in writing to Dakota Kitchen & Bath Inc.
The Limited Lifetime Warranty, the Five Year Limited Warranty and any legal claims or disputes relating thereto, shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to or application of a jurisdiction's conflict of laws principles. Purchaser submits to the jurisdiction of state and federal courts of the State of South Dakota for the resolution of any legal action arising out of the Limited Lifetime Warranty or the Five Year Limited Warranty.
